An unnamed Australian man from Point Vernon accused of child rape has been granted bail so he can feed his fish.
His fish are living at the alleged victim’s home.
The 37-year-old who faces four counts of rape appeared at Hervey Bay Magistrates Court where his bail conditions were changed to allow him to feed his fish.
The accused child rapist is in a relationship with the mother of the alleged victim.
The man’s solicitor Fiona Terrell said her client needed to return to the house to collect personal items.
"He also has pets, including tropical fish and freshwater fish, that his partner can't deal with," Ms Terrell said.
Ms Terrell said the mother of the alleged victim was in the courtroom, supporting the man, reported Fraser Coast Chronicle.
Senior Constable Sonia Edwards, Police prosecutor said she opposed the bail variation. She said that the child was the victim of serious allegations and should have a safe place place to go.
"When the bail was first granted the mother did say that her daughter did come first and it appears now she is changing that," Snr Const Edwards said.
Magistrate Stephen Guttridge granted a bail variation to allow the man to enter the home on Tuesdays and Thursdays between 11am and 1pm as long as the child was not there.
The case continues October 10.
